1.1. “PCAMasters” means PCA Masters PTE. LTD., a company incorporated in Singapore.
1.2. “User” means the client who engages PCAMasters's courier services.
1.3. “Services” means the courier services provided by PCAMasters to the User as set out on "www.PCAMasters.com".
1.4. “Terms and Conditions” means the Terms and Conditions that apply to the Services as set out on “www.PCAMasters.com” and may be amended from time to time.
2.1. The prices set out in www.PCAMasters.com are subject to change without prior notice.
2.2. The User shall pay PCAMasters either upfront through Credit Card or in cash all sums immediately when due, unless otherwise agreed by both parties.
2.3. All invoices are to be paid promptly or late payment penalty of $20 or 10% of the unpaid amount; whichever is higher will be imposed every 2 weeks until full payment has been completed.
2.4 Maximum credit term periods for all corporate customers is strictly 14 days from date of electronic invoice (which will be sent on the last working day of the calendar month or the first working day of the following calendar month)
2.4.1 In the event that there is a late payment or non-payment of a billable corporate credit bill/invoice, PCAMasters will reserve the rights to indefinitely suspend all delivery services and any future requests from that same User including the right to rescind the corporate credit terms whatsoever for that User without prior warning and/or take legal action against the User with any legal costs whatsoever borne by the User.
2.4.2. In the event there is a late payment or non-payment of a billable delivery by the User, PCAMasters will reserve the rights to indefinitely suspend all delivery services and any future requests from that same User including the right to rescind the corporate credit terms whatsoever for that User without prior warning and/or take legal action against the User with any legal costs whatsoever borne by the User.
2.5 Payments will only be by cash/credit card/debit card/Paypal/bank transfer for ad-hoc customers, while payments will only be by bank transfer/GIRO or cheque mailed to our office address for corporate credit customers.
2.6 In the event that corporate credit customers wish PCAMasters to collect cash as payment instead upon electronic PDF billing, that collection of cash will be considered as a separate trip/delivery and be billable to that User immediately upon collection of that cash.
3. User's Obligations
3.1. The User warrants that he is either the Owner or the authorized agent of the Owner of the Goods, and that he is authorized to accept and is accepting these Conditions not only for himself but also as agent for and on behalf of the Owner of the Goods.
3.2.1. The User shall give PCAMasters sufficient, accurate and executable instructions. Any extra costs arising from the difference between the provided information and actual situation shall be borne by the User.
3.2.2. The User understands and accepts that any free cancellations will only be entertained if it is informed via email or phone call (which must then be confirmed via email) at least 6 hours or more before the pick up timing.
3.2.3. The User understands and accepts that if any cancellation is made within 6 hours or less but before the pick up timing, cancellations will only be subject to a maximum of 50% refund.
3.2.4. The User understands and accepts that if any cancellation is made at or after the earliest possible pick up timing (according to the level of the service order placed, not according to the actual time the courier picks it up), there will be no refunds whatsoever under any circumstances to the User.
3.2.5. The User understands and accepts that if the item size is too large to fit onto a motorbike courier and yet still chooses a motorbike/small item delivery (estimated combined total of maximum L <35cm, W <30cm and H <20cm), PCAMasters reserves the right to reject the delivery at its own discretion. Additionally, all fees will still be billable and payable within the respective time frames if this is not informed prior to picking up of the package from the sender.
3.2.6. The User understands that if he/she cannot provide the exact dimensions of the package(s), and yet insists that it can fit onto a motorbike, PCAMasters may still attempt the delivery but clause 3.2.5 will apply.
3.3. The User shall ensure that every article is adequately packed to protect against damage in the course of transmission, and also that no part of the delivery items may be removed without the case, wrapper or container being torn or broken, a seal being broken or two adhesive surfaces being forced part.
3.4 The User warrants that he has complied with all laws and regulations relating to the nature, condition, packing, handling, storage and carriage of the Goods. User shall not dispatch and PCAMasters reserve the right to refuse any articles that are prohibited by law, dangerous or hazardous materials, perishable substances, and radioactive material. The User is liable for any loss or damage suffered by any third party as a result of any breach of the terms. PCAMasters will not open and inspect the Delivery Items, and bear no responsibility in any legal liability resulting from the transportation of the Delivery Items.
3.5. The User shall ensure that the name, address and the telephone number of the sender and addressee are completed accurately. For articles that are addressed to companies, the name of the company, address, name of addressee and department/section in which the addressee is located must be provided to ensure prompt delivery of articles.
3.6. If no one is present at the address stated in the order to receive the goods on the delivery date and time (if any) agreed by the User, the User shall be liable to pay an additional amount equivalent to the original fee for the extra transport charges incurred for the subsequent re-delivering of the goods to the intended recipient or returning to the sender.
3.7. The User is liable for all charges, costs or expenses of whatsoever nature, including but not limited to storage charges, duties and taxes, retrieval and administrative costs in connection with the cancellation of the Services by the User. For the avoidance of doubt, all fees charged for cancelled orders or returned articles are non-refundable.
3.8. The User agrees to indemnify and keep PCAMasters indemnified at all times from and against all demands, claims, actions, proceedings, charges, postages, costs or expenses, including but not limited to storage charges, duties and taxes, retrieval and administrative costs (including reasonable legal costs) incurred, suffered, or sustained by PCAMasters in connection with the Services performed.
3.9. The User agrees to allow PCAMasters to reproduce the User's company logo in PCAMasters' portfolio and in any marketing materials.
4. PCAMasters's Rights & Liability
4.1. PCAMasters reserves the right to terminate, temporarily suspend, refuse or reject any Services in the event of defaulted or non payment of any invoices without further notice. In the event payment recovery is seek through legal channel, all payments incurred shall be borne by the User.
4.2 As set out in http://www.pcamasters.com/delivery-rates/, unless otherwise agreed by both parties in writing, PCAMasters reserves the right to impose extra charges or reject the delivery of the items if:
4.2.1. the items exceeded the dimensions and/or weights or
4.2.2. any details regarding the items and delivery requirements changed without PCAMasters's knowledge and acceptance
4.2.3. the User is late to hand over the items, with reference to the stated collection time
4.3. PCAMasters shall take all reasonable precaution to prevent unauthorized persons from having access to the Delivery Items and shall also take all reasonable precaution against loss of or damage to the Delivery Items.
4.4. PCAMasters shall make reasonable effort to deliver the Delivery Item according to the respective delivery schedules, which are estimates only and not guaranteed. PCAMasters shall however not be liable (whether in contract, tort or otherwise) for any delays in effecting delivery of the article for whatever reasons.
4.5. Articles are delivered to the addressee’s address, as given by the User but not necessarily to the named addressee personally. Articles to addresses with a central receiving area will be delivered to that area. If the addressee refuses delivery or refuses to pay for delivery, or the article is deemed to be unacceptable, or it has been undervalued for customs purposes, or the addressee cannot be reasonably identified or located, PCAMasters shall use reasonable efforts to contact the User and agree on the appropriate action to take, failing which the article may be released, disposed of or sold by PCAMasters without incurring any liability whatsoever to the User or anyone else. The proceeds may be applied against any charges including but not limited to service charges and related administrative costs. The balance of the proceeds of the sale (if any) shall be returned to User. The User will be liable for costs incurred in forwarding, disposing of or returning the shipment and charges, including but not limited to storage charges, duties and taxes (if any) for making additional delivery attempts and/or for performing the agreed action to be taken.
4.6. For the avoidance of doubt, PCAMasters shall not in any way be involved or concerned with any claim for refund, return, rebate or exchange of any article. For all such articles the User or addressee shall deal directly with each other in respect of any refund, return, exchange, rebate and money-back guarantee policy and/or procedure at their own costs.
4.7. PCAMasters shall not be liable for any loss or damage arising from or in connection with:
4.7.1. User’s failure to specify any precautions to be taken in respect of a Delivery Item, as required under Clauses 3.3;
4.7.2. The delivery of any of the articles set out in Clauses 3.4;
4.7.3. PCAMasters’s failure to perform any of its obligations hereunder as a consequence of circumstances outside its control including but not limited to the outbreak of war, any governmental act, explosion, accident, civil commotion, riot, industrial dispute, strike, lockout, stoppages or restraint of labour from whatever cause whether partial or general, weather conditions, traffic congestion, mechanical breakdown, obstruction of any public or private road or highway or any other force majeure, fire, flood or any other acts of God;
4.7.4. Any acts or omissions of any party other than PCAMasters;
4.7.5. Any defects in respect of the article, even if known to PCAMasters when PCAMasters had accepted it;
4.7.6. Any electrical or magnetic damage to, or erasure of electronic or photographic images or recordings;
4.7.7. Any loss of secrecy in communication arising from the use of the Service.
4.8. PCAMasters shall not be liable for any indirect or consequential loss or damage.
4.9.1. The liability of PCAMasters shall be limited to 100SGD per consignment. All claims must be reported in writing with attached supporting evidence within 7 working days.
4.9.2 Any disputes/issues must be made known via email (even if call is made, an email has to be sent to PCAMasters) within 7 working days of the supposed event. All disputes/issues pertaining to PCAMasters billing/invoicing or services will strictly not be entertained whatsoever under any circumstances if more than 7 working days has elapsed from the date of the supposed event.
4.10 PCAMasters reserves the right to reject or reschedule any delivery if there is a delivery spike for that particular day resulting in a fully packed delivery schedule by informing the User prior to the delivery timing.
5. Personal Data and Privacy
5.1. The User agree that PCAMasters can use his/her personal data (namely his/her name and contact number) as provided by him/her to PCAMasters from time to time for the purpose of providing the Services.
5.2. The User agree that PCAMasters is entitled to collect, use, keep and update his/her personal data to such extent, for and at such time period as may be necessary when PCAMasters provides the Services to him/her, and the User confirm that the personal data so provided by him/her are true and correct and up to date.
6.1. This Terms and Conditions shall be subject to and construed in accordance with the laws of the Republic of Singapore and the parties hereby submit to the exclusive jurisdiction of the courts of the Republic of Singapore.
6.2. PCAMasters reserves the right, in its sole discretion, to change, update, modify or amend any of the terms and conditions stated herein, from time to time, without any prior notice to the User and the User shall be bound to observe and comply with the terms and conditions herein and any amendments thereof. Further, it shall be the responsibility of the User to review the terms and conditions for any such changes, revisions, modifications or amendments and that his/her continued use of the Services constitutes his/her agreement to such updated terms and conditions.
6.3 If any section, paragraph, clause or provision of the above Terms and Conditions on this page http://www.pcamasters.com/terms-conditions/ is adjudged by a court, agency, or authority of competent jurisdiction to be invalid, illegal or otherwise unenforceable, all remaining parts of this Terms and Conditions shall remain in full force and effect and PCAMasters and the User shall be bound thereby so long as principle purposes of this Terms and Conditions remain enforceable.
